Building Requirements

The lot owner shall have a choice of pre-approved builders for construction of a house.

The lot owner will be welcome to use another builder; however, the Architectural Review Committee must first pre-approve the builder.

All home plans must first be approved by the Architectural Review Committee.

Minimum square footage requirements:

Less than .50 acre lot – 2,800 square feet

.50 acres to .99 acres – 3,000 square feet

1 acre or more – 3,600 square feet

Minimum 2-car, rear or side-load garage.

Single-story house must have at least 10’ ceilings.

Exterior finish must predominantly consist of brick, stucco, stone, wood shingle or wood siding – no aluminum or vinyl siding is permitted. Hardie board may be used as a nonpredominant finish.
Construction Requirements
Basic Restrictions

Fences and walls shall be permitted, but must be approved by the Architectural Review Committee.

Below ground swimming pools, trampolines, play sets, etc. shall be permitted, but must be installed or kept no nearer to the side lot line than the greater of the side yard setback or the actual setback of the approved house.

No outbuildings or sheds shall be permitted.
Assessments

Amount of annual assessments is $350.00.

$200.00 transfer assessment must be paid upon the conveyance of any lot, which amount shall be paid to the Homeowner’s Association.

A refundable $1,000.00 construction assessment will be held for damage caused to any common area, including streets and curbs, or neighboring property by builder or subcontractors. If no damage occurs, the homeowner will receive return receipt the assessment.

The items noted are subject to change and should not be relied upon as a final understanding of the deed restrictions. All purchasers of a lot within the Subdivision will be provided with a copy of the Declaration of Restrictions, Covenants and Easements of Angel’s Path Subdivision filed with the Erie County Recorder prior to the final purchase of their lot.
